Compliance note: FDA allows certain small businesses to skip nutrition labeling if annual food sales fall below regulatory thresholds — but exemptions do not apply to nutrient content claims, supplements, or all interstate packaged goods. Verify annually.

Small business exemption basics

FDA provides relief for businesses with:

  • Low gross food sales (threshold updated periodically — check current 21 CFR 101.9 guidance)
  • Low unit volume for individual products in some cases

Exemption is not automatic — you must qualify and document eligibility.

When exemption does NOT apply

  • Products bearing claims ("low fat", "high protein")
  • Dietary supplements (always need Supplement Facts)
  • Foods sold to national retail chains requiring vendor compliance
  • Exported products where destination country mandates labels
