Compliance note: FDA allows certain small businesses to skip nutrition labeling if annual food sales fall below regulatory thresholds — but exemptions do not apply to nutrient content claims, supplements, or all interstate packaged goods. Verify annually.
Small business exemption basics
FDA provides relief for businesses with:
- Low gross food sales (threshold updated periodically — check current 21 CFR 101.9 guidance)
- Low unit volume for individual products in some cases
Exemption is not automatic — you must qualify and document eligibility.
When exemption does NOT apply
- Products bearing claims ("low fat", "high protein")
- Dietary supplements (always need Supplement Facts)
- Foods sold to national retail chains requiring vendor compliance
- Exported products where destination country mandates labels
